Planning Commission to consider request to vacate part of residential street

The Planning Commision is tackling whether or not to vacate a portion of East N Street at its Thursday meeting.

Applicants Daraius and Judith Tata are requesting the city vacate portions of unimproved right-of-way adjoining two sides of the property located at 121 East N St. In order to facilitate the development of a single-family home, the Tatas’ request includes the vacation of approximately 2,000 square feet of alley right-of-way at the rear of the property and 1,977 square feet of East N Street right-of-way at the front of the property.

According to a staff report, the topography of the area is distinguished by a general downward slope from northwest to south. The right-of-way next to the front property line has a slope that contains approximately 17 feet from west to east along the front of East N Street, and the alley has a slope of about 8 feet from north to south. There is also an open drainage channel bisecting the lot diagnolly from northwest to southwest.

“The water conveyed through the open channel originates from the residential neighborhood northwesterly of the property, including the Benicia Cemetery site,” staff wrote in the report. “The city will continue to evaluate the drainage through its review of the building permit for the single-family home.”

The Planning Commission must conduct a public hearing to determine the General Plan regarding any street vacation, abandonment or acquisition of real property for any purpose in In accordance with Government Code Section 6540. Following the Planning Commission’s decision, the City Council will hold a public hearing and then make a decision to approve or deny the proposed right-of-way vacation subsequent to the Planning Commission’s determination.

City staff recommends the Planning Commission Adopt the resolution finding that the proposed vacation of right-of-way is consistent with the General Plan.

In other business, the Planning Commission will nominate and then vote on a new chair and vice chair.

The Planning Commission will meet at 7 p.m. tomorrow in the Council Chamber of City Hall, located at 250 East L St.
